Child Protection and Safety in Missouri Child Care Settings

The Issue From 2007 through 2010 at least 45 children, primarily babies, have died in Missouri child care settings. Thirty-five of those deaths have been sleep-related. In most of the sleep-related deaths, it was discovered the caregiver failed to follow safe sleep practices that led to accidental suffocation of the infant. All but four of the sleep deaths occurred in unlicensed child care facilities. Although statistics for 2011 are not complete, at least nine more children died in child care last year, and six of them were sleep-related, putting the total count of child care deaths from mostly preventable causes at 54 in the past five years. Current Missouri laws and regulation, which are among the weakest in the nation, do not provide a strong foundation for preventing these deaths or sanctioning child care providers when they occur. Over the past several years there have been efforts to pass legislation – Nathan’s Law and Sam Pratt’s Law – to strengthen the legal and regulatory base for improving child safety and preventing child deaths. A St. Louis Post-Dispatch series by Nancy Cambria that ran in Fall 2011 and follow-up articles have heightened public awareness of this problem and brought increased legislative and prosecutorial focus. New legislation with bipartisan support has been introduced in the current session of the Missouri State Legislature. Organizations across the state concerned about child protection have adopted an intensive focus on the issue. The business community has added its voice to the call-to-action to address this problem.
